On President Trump’s first day in office he signed a handful of executive orders to launch his promised crackdown on immigration and declared a national emergency at the border to empower the military to support border patrol. Sending active-duty troops to the border is not new and it is legal. But, it becomes illegal when active-duty members of the U.S. military start carrying out law enforcement functions on American soil. One of Trump’s executive orders tests the legal limits of using the military to enforce domestic operations. What President Trump appears to be doing is equating immigration with territorial integrity in order to justify the use of the military at the border.
